Big Box Rules
Recommendations
The Charlotte-Mecklenburg Planning Commission on Monday heard
recommendations for rules on reusing abandoned big-box stores and preventing
new ones from becoming empty. The report concludes an 18-month study by city
officials, planners and real-estate representatives.

NC Steering Development Away from Military
Gov. Mike Easley's office is studying ways to steer development away from
military bases and flight training routes, which criss-cross the state like
broad aerial highways.

Pessimistic Economic Forecasts
Gov. Mike Easley and legislative leaders say new, more pessimistic economic
forecasts for the coming budget year predict a further $55 million
drop in state revenue, forcing lawmakers to contemplate new sources of money
or still more cuts.

NCAR Works with
AANC To Amend Landlord Tenant Bill
Senate Bill 847 (Tenant Late Fee/Early Military Lease) was amended in
Committee to remove language that would have permitted members of the armed
forces who receive temporary duty orders to terminate a lease on 30-day
notice. Property managers in Fayetteville and Jacksonville were concerned
and surprised at the bills introduction and felt the legislation was
overkill to a very rare situation. Meetings are being planned with military
housing personnel in order to study if this problem exists in military
communities. NCAR worked very closely with the lobbyist and leadership of
the Apartment Association of NC to remove the provision. The AANC was
celebrating its Annual Legislative Day during the week and were very
effective in promoting not only apartment issues, but housing issues as
well. Stephanie Simpson, NCAR Governmental Affairs Director was a speaker at
their legislative briefing where she updated attendees on the industry bills
and issues impacting NCAR.
Tourism Grant
Program Passes House Finance Committee
A program to help finance publicly owned sports arenas, convention centers
and other projects designed to increase North Carolina tourism has again
passed a House committee. The House Finance Committee agreed Thursday to the
grant program, which ultimately could hand out up to $60 million annually in
the form of rebates on taxes the projects are estimated to generate. The
same committee approved a similar bill last year, but the House
budget-writing panel later narrowly rejected it. Critics have complained the
measure is a backdoor way for the city of Charlotte to help pay for a
planned arena for its new NBA franchise. But supporters, many of whom are
from the Charlotte area, say the bill will help local governments large and
small create attractions that will lure out-of-town residents to visit and
spend their money, generating additional revenues and jobs. Other projects
that could potentially qualify for the grants include a performing arts
center in Durham,
minor league baseball parks in Charlotte and Asheville, a Marine museum in
Jacksonville and convention centers in Concord and Gastonia.

Judge OKs bid for Ecusta
What's left of RFS Ecusta in Pisgah Forest will be sold to a South Carolina
firm as soon as the end of this month following a ruling by U.S. Bankruptcy
Court Judge George Hodges in Charlotte. Without opposition, Hodges approved
a $1.3 million bid for the Ecusta mill, surrounding property and other
assets made by New Tech Environmental of Fort Mill, S.C. The company plans
to turn the sprawling property into an industrial park and may reuse some of
the paper mill equipment.

New and Revised
Forms
Effective July 1, several new forms are being added to the NCAR forms
library and a number of current forms are being revised. The new and revised
forms are summarized in detail in the Summer 2003 issue of the General
Counsel Quarterly, which you can read at
http://www.ncrealtors.org/pubs/GCQ/gcq-0603.htm. An article on the new
and revised forms also will appear in the June/July issue of Tar Heel
REALTOR®, which you will be receiving soon. “Clean” copies of the new
and revised forms will be available on the NCAR Web site on Friday, June 27,
and they have been sent to NCAR's approved forms software vendors. You
should contact your vendor regarding the anticipated “roll-out” date of an
update to your forms software program.

Convention
With summer just around the corner, it’s time to start making plans to
attend NCAR’s Annual Convention, planned for Sept. 14-17 in Hilton Head,

A recent report by Moody's Investors Service shows occupancy was up in the

Office Vacancy
Rates May be Higher Than Reported
"Hidden space," particularly buildings that are leased and vacant or
occupied and for-lease, could drive vacancies in several submarkets 20
percent to 37 percent higher than reported rates, according to a new report
from CRESA Partners LLC. The first quarter 2003 report says that vacancies
for Class-A downtown space, accounting for sublease space, is at a record
16.15 percent. The vacancy rate for Class-B downtown, including sublease
space, is currently at 16.81 percent.

Cindy Chandler, CRE, CCIM was elected Vice Chair of the Char-Meck Planning
Commission and Chair of the Zoning committee on June 2. Cindy has served on
the Planning Commission for three years and was recently reappointed for an
additional three years by the Mayor. She is also the current Chair of the
Realtors Commercial Alliance of NCAR - the commercial division and will be
Chair of NCAR's Professional Standards Committee in 2004.
Transwestern Chosen
to Market New Project in Wilmore Community
Transwestern Commercial Services, (TCS) announced that its Charlotte, NC
office has been chosen by Citiline Development Company to market a new
office/showroom project to be built at the corner of
South Tryon Street
and Remount roads in the Wilmore Community of
Charlotte,
NC. Citispace will feature 40,000 square feet of office
and showroom space in three buildings on 2.7 acres. Transwestern brokers
Andrew Webb and Tina Long are in charge of selling the units.
